Florida voters will see recreational marijuana on the ballot in Florida as an initiated constitutional amendment , known as Amendment 3, on Tuesday, Nov. 5. Amendment 3 seeks to legalize recreational marijuana, allowing those 21 and older to have up to 3 ounces and up to 5 grams of cannabis concentrate.

The measure would have allowed adulta to possess about 3 ounces of pot, and it would have allowed businesses already growing and selling medical marijuana to sell it to them.

Florida voters rejected recreational marijuana legalization Tuesday night, dealing a huge blow to the industry and those that had bet heavily on opening up what could have been the nation’s third-largest market.

Sponsored by Smart & Safe Florida and sent to the Supreme Court before being ruled constitutional on April 1, 2024, Amendment 3 would allow adults 21 years or older to possess, purchase or use marijuana products and marijuana accessories for nonmedical, personal consumption. This includes smoking, ingestion or otherwise.

Florida voters in the General Election will decide whether or not to legalize recreational marijuana for adults over 21 years old.

Voters in three states will decide whether to legalize recreational use. Earlier this year, Pew reported that 88% of U.S. adults said marijuana should be legal for medical or recreational use.

Three more states are voting today on whether to legalize the recreational use of cannabis — and if more than one of the measures passes, it would mean a majority of U.S. states have recreational marijuana laws on the books.
